AGENCY DESIGNATED
Pursuant
to the provisions of the Michigan Electrical Code,
in accordance with Section 8b(6) of Act 230, of
the Public Acts of 1972, as amended, the Building
Official of the Village of Beverly Hills is hereby
designated as the enforcing agency to discharge
responsibility of the Village of Beverly Hills under
Act 230, of Public Acts of 1972, as amended, State
of Michigan. The Village of Beverly Hills assumes
responsibility for the administration and enforcement
of said Act throughout its corporate limits.{Ord.

25.02
CODE REFERENCED
All
electrical equipment in any buildings, structures
and premises covered by this Ordinance shall be
designed, constructed, installed, altered and maintained
in accordance with the provisions of the State Code.
This Code provides reasonable safeguards to the
public health, safety and welfare as they are affected
by the installation and/or maintenance of electrical

25.03
FEES FOR INSPECTION
When
an application is made for a permit, license, or
registration required under the terms of this Ordinance,
a fee shall be paid in an amount as prescribed by
Resolution of the Village of Beverly Hills Council.

25.04
RIGHT OF ACCESS TO BUILDING
Subject
to the Constitution and the laws of the State of
Michigan, the Building Official and/or his or her
deputy shall have the right during reasonable hours
to enter any building in this discharge of his or
her official duties for the purpose of making any
inspection or test of the installation of electrical
wiring, electrical devices and/or electrical materials
contained therein and shall have the authority to
cause the turning off of all electrical supply and
to disconnect, in cases of emergency, any wire where
such electrical currents are dangerous to life or
property or may interfere with the work of the Fire

25.05
PERMITS
It
shall be unlawful for any person, firm or corporation
to install, alter, maintain, service or repair electrical
equipment in or on any building, structure or part
thereof, or on premises or cause or permit therein
or thereon the installation, altering, maintaining,
servicing or repairing of any electrical equipment
without a permit having been obtained therefore
as provided herein. Nothing in this section shall
be considered as applying to any person engaged
in repairing and maintaining electrical appliances.

25.06
INSPECTION
Upon
the completion of the wiring of any building, it
shall be the duty of the person, firm or corporation
installing the same to notify the Electrical Inspector
to inspect the installation as soon as possible,
and if it is found to be fully in compliance with
this Code and does not constitute a hazard to life
and property, he shall issue on request to such
person, firm or corporation for delivery to the
owner a certificate of inspection authorizing connection
to the electrical service and the turning on the
current. All wires which are to be hidden from view
shall be inspected before concealment and any person,
firm or corporation installing such wires shall
notify the Village of Beverly Hills, giving sufficient
time in which to make the required inspection before
such wires are concealed.
25.07
REINSPECTION
The
Electrical Inspector may make periodically a thorough
reinspection of the installation in buildings of
all electric wiring, electric devices and electric
material now installed or that may hereafter be
installed, within the Village of Beverly Hills and
when the installation of any such wiring, devices,
and/or material is found to be in a dangerous or
unsafe condition, the person, firm or corporation
owning, using or operating the same shall be notified
and shall make the necessary repairs or changes
required to place such wiring, devices and material
in a safe condition and have such work completed
within fifteen (15) days, or any longer period specified
by the Electric Inspector in said notice. The Electrical
Inspector is hereby empowered to disconnect or order
in writing the discontinuance of electrical service
to such wiring, devices, and/or material so found
to be defectively installed until the installation
of such wiring, devices and material has been made
safe as directed by the Electrical Inspector.
25.08
CONSTRUCTION REQUIREMENTS
No
certificate of inspection shall be issued unless
the electrical installation is in strict conformity
with the provisions of this Code, the statues of
the State of Michigan, the rules and regulations
issued by the Michigan Public Service Commission
under the authority of the State statutes, and unless
they are in conformity with approved methods of
construction for safety to persons and property.
The regulations as laid down in the National Electrical
Code, as approved by the American Standards Association
and in the National Electrical Safety Code, as approved
by the American Standards Association, and in the
Village of Beverly Hills' rules and regulations
established as hereinafter provided (Section 25.11f)
shall be prima facie evidence of such approved methods.
25.09
APPROVED MATERIALS
It
shall be unlawful to install or use any electrical
device, apparatus, or equipment designed for attachment
to, or installation on any electrical circuit or
system for heat, light or power that is not of good
design and construction and safe and adequate for
its intended use. The Electrical Inspector shall
have power to disapprove the use or installation
of devices not fulfilling these requirements. Devices,
apparatus and equipment approved by such generally
recognized authorities as United States Bureau of
Standards, Electrical Testing Laboratories of New
York, or Underwriters Laboratories shall be held
to have the approval of the Electrical Inspector
unless explicitly disapproved by said Authority
for reasons for faulty design nd poor construction
involving danger to persons and/or property.
It
shall be the duty of the Electrical Inspector from
time to time to inspect devices, apparatus and equipment
offered to the public for use in installation to
see that such items conform to the above requirements.
25.10
RECORD AND REVIEW
(a)
The Village of Beverly Hills shall keep complete
records of all permits issued and inspections made
and other official work performed under the provisions
of this Code.
(b)
When the Electrical Inspector condemns all or part
of any electrical installation the owner or his
agent may within five (5) days after receiving written
notice from the Electrical Inspector, file a petition
in writing for review of said action of the Electrical
Inspector with the Board of Electrical Examiners,
upon receipt of which the said Board of Electrical
Examiners shall at once proceed to determine whether
said electrical installation complies with this
Code, and within three (3) days shall make a decision
in accordance with its findings.
25.11
LICENSE FOR ELECTRICAL WORK
(a)
A Board of Electrical Examiners is hereby constituted
consisting of the Electrical Inspector of the Village
of Beverly Hills, a representative of an electrical
utility company, a licensed Electrical Contractor,
who is also a licensed Master Electrician, a licensed
Journeyman Electrician, and the said Electrical
Contractor and Journeyman Electrician shall have
had at least ten (10) years experience in electrical
work. The members of said Board of Examiners shall
be appointed by the Village Council of the Village
of Beverly Hills for such terms as shall be designated
at the time of appointment. This Board shall examine
all applicants for either Master Electrician's or
Journeyman Electrician's licenses. Applicants failing
to pass will not be eligible for re-examination
in any reciprocating municipality for a period of
thirty (30) days. All applicants for licenses shall
designate their legal address as the location for
their residence in the case of Journeyman and Master
Electricians, and their legal address as the principal
place of business in the case of electrical contractors.
All Electrical Contractors, Master Electricians,
and Journeymen Electricians having their legal address
within the corporate limits of the Village of Beverly
Hills shall secure their license from the Village
of Beverly Hills.
The
Board of Electrical Examiners shall prepare the
application blanks, prescribe the examination and
meet at least once a month on call of the Village
of Beverly Hills to hold examinations. Due notice
shall be given applicants of the date of examination.
All
applications for examinations shall be in writing.
The examination shall consist of an oral or written
examination as the Examining Board shall determine,
and such other practical tests in examination at
the discretion of the Examining Board.
It
shall be unlawful for any person, firm or corporation
to engage as an independent contractor in the installation,
alteration, maintenance or repair of electrical
wiring, equipment, apparatus or fixtures for light,
heat or power purposes, where the electromotive
force exceeds thirty (30) volts in or about buildings
and/or structures located within the Village of
Beverly Hills without first having procured a license.
(b)
ELECTRICAL CONTRACTOR'S LICENSE REQUIREMENTS
An
applicant for an Electrical Contractor's License
shall be over eighteen (18) years of age and shall
be the holder of a Master Electrician's License,
or shall regularly employ a person who is the holder
of a Master Electrician's License who shall be actively
in charge of work for the applicant.
To
be issued by community in which business is located.
It
shall be unlawful for any person to engage in the
occupation or trade of Journeyman Electrician in
the installation, alteration, maintenance or repair
of electrical wiring equipment, apparatus or fixtures
for light, heat, power or medical purposes where
the electromotive force exceeds thirty (30) volts
in or about buildings and/or structures within the
Village of Beverly Hills without having first taken
the examination and obtained a license as herein
provided. This provision shall not apply to helpers
and apprentices, provided such work as they may
do is performed under the direction and supervision
of licensed Journeyman Electricians who shall be
on the premises at all times when such helpers or
apprentices are performing such work on the premises.
(c)
JOURNEYMAN ELECTRICIAN LICENSE REQUIREMENTS
An applicant in order to qualify for examination
for Journeyman electrician License shall have attained
the age of eighteen (18) years and shall be able
to show four (4) years of practical experience in
the type of electrical construction or maintenance
work for which a license is required. In lieu of
four (4) years of practical experience, an applicant
shall present evidence of a total of not less than
four (4) years in a combination of practical experience
and training at a recognized trade or technical
school, provided this includes a minimum of one
(1) year practical experience. Evidence in writing
from employers and technical schools shall be submitted
by the applicant, showing type of work performed
and length of time employed. All applicants shall
submit to an examination as hereinafter provided.
(d)
MASTER ELECTRICIAN LICENSE REQUIREMENTS
An
applicant for a Master Electrician License shall
submit to the examination hereinafter provided and
have attained the age of eighteen (18) years. Said
applicant for a Master Electrician License shall
have passed the examination for and had issued to
him a Journeyman Electrician License for a period
of at least two (2) years. He shall further agree
that if a Master Electrician License is issued,
he will notify the Board in writing within seventy-two
(72) hours (three working days) of a change of employment
where such employment was necessary to qualify his
employer as an Electrical Contractor. Willful or
negligent failure to give such notice of the Board
shall be grounds for suspension or revocation of
such license.
(e) The fee for an Electrical Contractor's, Master
Electrician's and Journeyman Electrician's License
shall be prescribed by the Village Council. Licenses
shall expire on December 31st of each year, and
shall be renewed upon application by the licensee,
together with the payment of the required fee. After
March 1st, all licenses not renewed shall be considered
cancelled and may not be renewed except upon approval
of the Examining Board. Electrical Contractor's,
Master Electrician's and Journeyman Electrician's
Licenses shall be issued by the Village of Beverly
Hills upon recommendation of the Examining Board.
Licenses issued under this Code shall be nontransferable
and shall be displayed when required. Electrical
Contractor's Licenses under the terms of this Code
shall not secure permits for work to be done by
any person not employed by said Electrical Contractor,
and license may be revoked for violation for this
rule.
No
license shall be recognized by the Village of Beverly
Hills unless such licenses are issued by a cooperating
municipality having an Examining Board.
The
Village of Beverly Hills shall permit Electrical
Contractors lawfully licensed by other municipalities
of the State of Michigan to install, alter or repair
electrical wiring, equipment, apparatus or fixtures
for light, heat or power purposes within the corporate
limits of the Village of Beverly Hills, upon payment
of Five Dollars ($5.00) registration fee, provided
that such municipalities reciprocate in recognizing
Electrical Contractors who are duly licensed under
the provisions of this Code by granting them the
same privilege and charging the same uniform license
and registration fees. Provided further, that the
licensing ordinances are substantially equal to
the requirements of this Code. Journeyman Electricians
duly licensed by any municipality cooperating in
the reciprocal arrangement shall be permitted to
work in the Village of Beverly Hills without the
payment of a registration fee. provided, however,
that any Journeyman Electrician doing work within
the Village of Beverly Hills, and holding a license
from a cooperating municipality, shall register
with the Village of Beverly Hills.
No
Electrical Contractor's Licenses shall be recognized,
for the purpose of registration, by the Village
of Beverly Hills of applicants who maintain their
principal place of business in a municipality which
fails to approve, by affirmative action of its legislative
body, the reciprocal and mutually interchangeable
licensing arrangements covered by this Code.
Corporations applying for Electrical Contractor's
Licenses, whose principal place of business is not
in the State of Michigan, should obtain such license
from the State of Michigan Electrical Administrative
Board upon the payment of the prescribed fee.
Any
Electrical Contractors, Master or Journeyman's License
may, after a hearing, be suspended or revoked by
the Examining Board having issued such license upon
evidence present that false statements have been
made upon application for license or upon evidence
presented that the person firm or corporation holding
such license willfully or by reason of incompetence
repeatedly violates any rules and regulations relating
to the inspection, maintenance, alteration or repair
of electrical wiring, devices, appliances or equipment.
(f)
The Board of Electrical Examiners is hereby empowered
and it shall be their duty to promulgate and recommend
such rules and regulations concerning electrical
work in the Village of Beverly Hills as may be required
to properly provide for the situations therein.
The rules and regulations so made by the Board of
Electrical Examiners shall be effective upon approval
by the Village of Beverly Hills, and shall take
precedence over plans specifications and National
Electric Code Rules.
(g)
A licensed electrician shall not be required for
any wiring in or on a home and accompanying outbuildings
owned, occupied or to be occupied by the person
performing the installation, alteration or repair
of wiring, devices, appliances and appurtenances,
providing the Inspector deems such person qualified
to perform such work and such person obtains a permit
as required by this Code.
25.12
EXCEPTIONS
The
provisions of this Code shall not apply to the following:
(a)
The installing of radio receiving sets and equipment.
(The installation of convenience outlets for power
supply to a radio set shall be subject to such rules
and regulations.
(b)
This Code and its provisions shall not apply to
apparatus and equipment installed by or for any
public utility operating under the jurisdiction
of the Michigan Public Service Commission in the
exercise of its function as a utility and when such
apparatus or equipment is used primarily for the
generation or distribution of electric current or
for signal or communication purposes.
25.13
LIABILITY
This
Code shall not be construed to relieve from or lessen
the responsibility or liability of any party owning
, operating, controlling or installing any electric
wiring, electric devices and/or electric material
for damages to person or property caused by any
defect therein nor shall the Village of Beverly
Hills be held as assuming any such liability by
reason of the inspection authorized herein, or certificate
of inspection issued as herein provided.
25.14
VIOLATIONS
Any
person, firm or corporation who shall fail to comply
with any of the provisions hereof, shall upon conviction
thereof, be subject to the penalties set forth in
Section 1.06.
