6.01
SUPERVISION
(a) All parks in the Village of Beverly Hills shall
be operated under the supervision of the Village
Manager of the Village of Beverly Hills.
(b) The Village Manager shall in addition to his
duties prescribed by the Village Charter be Park
Superintendent and shall enforce all ordinances,
rules and regulations in relation thereto.
6.02
REGULATIONS
It
shall be unlawful for any person to violate any
regulation governing conduct in the Village parks
which has been approved by the Village Council.
6.03
AMUSEMENT FOR GAIN
No
amusement for gain or for which a charge is made
can be conducted in a park without consent of the
Village Council and such amusement must be conducted
in accordance with any ordinance pertaining thereto
and such further regulation as the Council shall
prescribe.
6.04
PARK PROPERTY PROTECTION
It
shall be unlawful for any person in a park to:
(a) Disfiguration and Removal. Willfully mark, deface,
disfigure, injure, tamper with, or displace or remove
any building, bridges, tables, benches, fireplaces,
railings, lines or other public utilities or parts
or appurtenances thereof, signs, notices or placards
whether temporary or permanent, monuments, stakes,
posts, or other boundary markers, or other structures
or equipment, facilities or park property or appurtenances
whatsoever either real or personal.
(b) Restrooms and Washrooms. Fail to cooperate in
maintaining restrooms and washrooms in a neat and
sanitary condition. No person over the age of five
years shall use the restrooms and washrooms designated
for the opposite sex.
(c) Sanitation. Throw, discharge, or otherwise place
or cause to be placed in the waters of any fountain,
pond, pool, or other body of water in or adjacent
to any park or any storm sewer, or drain, any substance,
matter or thing, liquid or solid, which will or
may result in the pollution or stoppage of said
waters.
(d) Rubbish, Refuse and Trash. Have brought in or
shall dump, deposit or leave any bottles, broken
glass, ashes, paper boxes, cans, dirt, rubbish,
waste, garbage or refuse, or other trash. No such
refuse or trash shall be placed in any fountain
or pool, or left anywhere on the grounds of any
park, but shall be placed in the proper receptacles
where these are provided; where receptacles are
not so provided, all such rubbish or waste shall
be carried away from the park by the person responsible
for its presence, and properly disposed of elsewhere.
6.05
OPERATING POLICY
(a) Hours. The public park shall be opened daily
to the public during the hours of 8:00 A.M. and
10:00 P.M. of any one day; and it shall be unlawful
for any person, or persons (except in the instance
of prior written approval of the Park Superintendent
or his designee or in the case of Village personnel
conducting Village business therein), to occupy
or be present in said park during any hours in which
the park is not open to the public.
Any section, or part of the park, may be declared
closed to the public by the Park Superintendent
at any time for any interval of time, either temporarily
or at regular stated intervals.
(b) Group Activity. Whenever any organized group,
association or organization desires to use the park
facilities for a particular purpose, except the
athletic fields, for such as picnics, parties or
theatrical or entertainment performances, a representative
of the group, association or organization shall
first obtain a permit from the Park Superintendent
or his designee for such purposes. The Village Council
may adopt an application form to be used by the
Park Superintendent for such situations.
The Park Superintendent or his designee shall grant
the permit if it appears that the group, association
or organization will not interfere with the individual
members of the public, and if the group, association
or organization meets all other conditions contained
in the application. The application may contain
a requirement for an indemnity bond to protect the
Village from any liability of any kind or character
and to protect Village property from damage. The
Village Council may adopt by resolution a fee schedule
for the issuance of a permit.
While non-organized groups may use the park facilities
without a permit on a first-come, first-served basis,
exclusive use of the park pavilion, in case of conflict,
will be given to an organized group or association
who has obtained a permit.
6.06
PICNIC AREAS AND USE
No
person in a park shall:
(a) Regulations. Picnic or lunch in a place other
than those designated for that purpose. Attendants
shall have the authority to regulate the activities
in such areas when necessary to prevent congestion
and to secure the maximum use for the comfort and
convenience of all. Visitors shall comply with any
directions given to achieve this end.
(b) Nonexclusive. Use any portion of the picnic
areas or of any of the buildings or structures therein
for the purpose of holding picnics to the exclusion
of other persons, nor shall any person use such
area and facilities for an unreasonable time if
the facilities are crowded, except permit holders
shall have exclusive use of the pavilion.
(c)
Duty of Picnickers. Leave a picnic area before the
fire is completely extinguished and before all trash
in the nature of boxes, papers, cans, bottles, garbage
and other refuse is placed in the disposal receptacles
where provided. If no such trash receptacles are
available, then refuse and trash shall be carried
away from the park area by the picnicker to be properly
disposed of elsewhere.
6.07
GENERAL REGULATIONS
(a) Costumes. No person in a park shall appear in
bathing costume at any place in the parks except
within the limits of designated bathing places or
areas, and all bathing costumes shall conform to
commonly accepted standards.
(b) Animals. No person shall bring or harbor any
animals in a park unless the animal is contained
on a leash. Animals shall not be allowed in or near
the pavilion or playground area. Any animal fecal
matter shall be immediately collected and removed
from the park.
(c) Liquor and Alcoholic Beverages. No person shall
have in his possession, custody or control, any
liquor (except beer and wine) in the park or any
part thereof. Any person found intoxicated in a
public park shall be considered a disorderly person
and guilty of disorderly conduct.
6.08
MERCHANDISING, ADVERTISING AND SIGNS
No
person in a park shall:
(a) Vending and Peddling. Expose or offer for sale
any article or thing, nor shall he station or place
any stand, cart, or vehicle for the transportation,
sale or display of any such article or thing, except
as to any regularly licensed concessionaire acting
by and under the prior authority and regulation
of the Village Council.
(b) Advertising. Announce, advertise, or call the
public attention in any way to any article or service
for sale or hire except as provided in this section.
(c) Signs. Paste, glue, tack or otherwise post any
sign placard, advertisement, or inscription whatever
in a park, nor shall any person erect or cause to
be erected any sign whatever on any public lands,
streets, or highways or roads adjacent to a park.
(d)
Pavilion Permit Holders. Pavilion permit holders
shall be allowed to place identification banners
on the hooks and posts provided.
6.09
PROGRAMS
The Park Superintendent of the Village may conduct
or permit sports and/or recreational programs in
or on the area generally set out for such purpose.
The Parks Superintendent may allow scheduling for
the active play facilities, i.e., ball diamonds,
volleyball courts, basketball courts, as community
conditions warrant. In such event, the Park Superintendent
may permit the park to be open during reasonable
hours for such purposes, except no regulation or
other provisions of this chapter shall be waived
or nullified thereby.
6.10
MOTOR VEHICLES
(a) It shall be unlawful for any person to operate
a motor vehicle, including motorcycles, minibikes
and scooters, in any area other than the designated
parking lot.
(b) The Public Safety Department shall place or
install suitable signs indicating parking areas
under the direction of the Park Superintendent,
and it shall be unlawful for any person to park
a motor vehicle in the park or adjacent streets
other than indicated by such signs.
(c) The provisions of Chapter 41 of this code relating
to traffic apply to the operation of motor vehicles
in the Village parks and all adjacent streets except
as to such as is herein promulgated, set forth and
modified for park regulation of motor vehicle traffic
and parking.
(d) It shall be unlawful for persons to cruise about
the park in motorcycles, so-called "mini-bikes,"
motor scooters and the like. All such vehicles when
standing or parked shall have the motor completely
shut off so as to emit no sound, noise, fumes or
smoke at all.
(e) It shall be unlawful for any person to unnecessarily
blow, sound or operate any horn or signaling device
or operate or have any device that backfires or
creates any sound or noise louder or more disturbing
than such device that is originally installed with
such motor vehicle by the manufacturer thereof.
(f) No motor vehicle, motorcycle, mini-bike, or
motor scooter shall be started up, accelerated,
or operated so as to create such disturbance or
noise as to attract attention to such operation
by the public.
6.11
PARENTS RESPONSIBILITY
Parents
shall be responsible for the conduct of minor children.
6.12
VIOLATIONS
Any
violation of the provisions of this chapter shall
subject the violator to the penalties set forth
in Section 1.06.
